When we issue fixed penalty notices for night time noise
The offence of emitting excessive noise from a dwelling at night, between the hours of 11pm and 7am, has been introduced. Environmental Health officers working on the out of hours noise patrol are able to issue fixed penalty fines.
The offence was introduced by an amendment to The Noise Act 1996 by the Anti-Social Behaviour Act 2003.
How it works
First a Warning Notice is issued to the occupier of a noisy premises or person responsible for the noise. If the noise measured in a neighbouring property is not reduced a fixed penalty of £100 may be payable. Alternatively the council can prosecute and any noise making equipment such as stereo systems can be seized pending court proceedings.
Noise patrol operates on Friday and Saturday nights between the hours of 10pm and 3am. They can be contacted on 01273 293 541.
